Who are overstaying?
All the travelers who are granted an entry Vietnam visa (tourist visa or business visa) or those who enter Vietnam with visa exemption will be considered as overstaying if they stay in Vietnam 1 day or more after the permitted date (visa expiry date).
How serious of visa overstaying and the penalties?
According to the Vietnam Law on Entry, Exit and Residence of the foreigners 2015, the overstaying activities are administrative and social security violations. Depending on the level of violation, times and the traveler’s activities, different penalties will be given.
Fines for overstaying and how much?
For those who are overstaying for a few days, the fines will be charged by day;
For those who are intentional violation or those who are overstaying for long time, the travelers are forced to leave the country after paying the administrative penalties;
For those who intentionally commit repeated offenses for a long time, without respecting for the law, the level of punishment may include administrative penalties, limitation of Vietnamese immigration and enforced deportation.
Below is the amount of fines referred from social networking and informal sources:
- Overstaying up to 5 days fine: 1,250,000 VND (55 USD) is a common penalty;
- Overstaying up to 1 month: 4,000,000 VND (175 USD) is a common penalty;
- Overstaying from 1 to 3 months: fines of about 10,000,000 VND (440 USD)
- Overstaying one year: the penalty is more than 16,000,000 VND (700 USD) and forced exit, restrictions on entry and exit and prohibited within the specified period.
Overstaying visa can be extended or not?
It is the responsibility of the immigration authorities to assist the foreigners in Vietnam when they are overstaying. These organizations are extremely helpful and dedicate to assist the travelers. However, with the strictness of the law, only those who provide honest declaration with a good reason can be considered to support the extension and it is allowed to extend if the violations are not serious.
How to extend the overstaying business visa?
When the travelers, who hold a business visa, are overstayed a sponsor agency is required to extend the visa. However, the extension is limited.
